The Supreme Court of Nigeria has vacated an earlier ruling by the Court of Appeal, which barred the recognition of David Mark as the National Chairman of the African Democratic Congress (ADC).
In a unanimous judgment delivered on Thursday, the apex court described the preservative order issued by the Court of Appeal as being made in bad faith, unnecessary, unwarranted, and improper.
Justice Mohammed Lawal Garba, who delivered the lead judgment, held that the appellate court erred in granting the order of status quo ante bellum, noting that such relief was not sought by any of the parties involved in the case.

The controversial order had led to the de-recognition of the ADC executive led by David Mark by the Independent National Electoral Commission (INEC).
However, with the Supreme Court’s decision setting aside the order, David Mark and other members of the party’s national leadership are now to be formally recognized by INEC as the legitimate executives of the ADC.
The ruling is expected to bring clarity to the leadership dispute within the party and reaffirm the authority of its current national officers.
